ONLINE TERMS AND CONDITIONS

The terms and conditions of sale apply exclusively to existing current and future business relationships between KAHA registered under the number SIREN 830 976 585 and the author of the order.

We may change these terms and conditions of sale at any time, subject to the presence of these changes on our website.

These conditions are intended to define the terms of sale between KAHA and the author of the order. These terms and conditions of sale are systematically brought to the attention of each buyer to allow them to place an order.

Warnings:

The manufacturer reserves the right to modify the technical characteristics of the products at any time and without warning without any notice and without entitling the buyer to any claim or refund. Any

DELIVERY TIME:

As a general rule, the merchandise is made available for 3 to 8 weeks (structure type product) and 1 to 2 weeks (accessory type product) after acceptance of the order by KAHA. However, these deadlines are indicative and are likely to be extended at any time. Failure to meet deadlines cannot in any way constitute a valid reason for cancelling an order or giving rise to compensation.

ORDER CHANGES:

Any quantitative or qualitative change in order that has become final can only be accepted if it does not disrupt manufacturing or supply. It could, if necessary, result in an increase in agreed prices and will result in a further delivery period.

ORDER CANCELLATIONS, RETRACTION AND PRODUCT RETURN: 

No cancellation – full or partial – of final order can be accepted unless written agreement on our part. If the seller's agreement is given in writing, this total or partial cancellation will result in the billing of a compensation for study, file and travel expenses at the buyer's home which will be 20% of the tax-free amount of the order.

In accordance with Article L.121-16 of the French Consumer Code:

In the event of the exercise of the right of withdrawal, the customer will have the choice to request, the refund of his order, except the shipping costs for the return that remain his responsibility. In the event of abusive or unjustified returns, KAHA reserves the right to refuse any further orders.

Rates:

The price of the products available in the KAHA online store on www.kaha-france.fr is shown in Euros and already includes the Value Added Tax (VAT), and at the end of the ordering process, the total price (shown in the payment menu), will also include shipping costs (if applicable).

In the delivery prices are included: packaging and handling. Prices are changeable at any time without notice under current regulations, knowing that items will be charged on the basis of registration of the order. All orders are billed in euros and payable in euros.

MOUNTING – INSTALLATION:

In the event that the goods are delivered disassembled, the assembly and installation will remain at the customer's expense. However, we can perform its duties according to the rate in effect on the day of deliv
ery. All travel is subject to billing according to the current schedule. We take all responsibility for any accidents that may occur on the use of our equipment as a result of errors in assembly or fixing performed other than by a member of the KAHA company, as well as accidents due to the mounting and fixing support of the structure.

EXPEDITIONS – TRANSPORT:

 Our goods travel at the peril of the recipient to whom it is the responsibility to make the usual reservations when receiving the goods, in case of loss, damage, in order to eventually sue the carrier. In the event of a dispute, specific reservations must be made on the delivery receipt and confirmed by recommended letter within 48 hours of receiving the goods from the carrier and supplier.

ORDERS AND PAYMENTS:

The order is validated upon receipt of the full payment of the order including the delivery fee if applicable, by online payment at the KAHA store on www.kaha-france.fr or other means available to the buyer.

Warranty:

Products manufactured and distributed by KAHA are guaranteed for a period of 1 year for products (accessory types) and 2 years on products (structure type) from the date of delivery.

The warranty does not cover the items listed below:

  • Elements that by their use are subject to wear.
  • The malfunction or ruptures caused by misuse or abuse of the installation.
  • The warranty does not cover the labour, the movement of technicians, the cost of shipping spare parts.
  • If there has been manipulation by a person outside the service without express permission.

PRODUCT REPLACEMENT OR REPAIR:

 KAHA, is the sole authority to decide whether to replace or repair the parts in accordance with the conditions and limitations announced in these warranty conditions. This guarantee does not require or compel anyone to make repairs beyond the limits expressly set out in the warranty. KAHA cannot be held responsible for economic losses, losses or consequential damages.

PROPERTY RESERVE:

KAHA reserves ownership of the goods, the object of this debit, until they are paid in full in accordance with Law 80.335 of 12 May 1980. Until that date, the material delivered will be considered recorded, the buyer will bear the risk of damage that the equipment may suffer or cause for any cause including in the case of force majeure or fortuitous, and this, as soon as shipme
